In Paris, elected officials are mobilizing against the deportation of an HIV-positive migrant

Human rights

With the call for the “benevolent attention” of the Minister of Health to this file, the elected representatives rely on Article 3 of Act No. European Convention on Human Rights forbidding inhuman treatmentas interpreted by the jurisprudence of the European Court of Human Rights.

At the bus stop Paposhvili v. Belgium of December 13, 2016, the court ruled that the threat of deportation of a person suffering from serious illnesses to the country of origin could, under certain conditions, be contrary to Article 3 of the ECHR. “Therefore, we believe that such an expulsion would be inhumane,” the two elected officials believe.
